Gates previously testified via a videotape deposition in (I recall) fall
1998. He has not testified in person before.

     From Microsoft:

This morning, Microsoft has provided attorneys for the non-settling states
a list of witnesses that we plan to call to the stand next week in the
remedy proceedings in Washington DC. Microsoft Chairman and Chief Software
Architect Bill Gates is included on this list. We plan on calling Mr.
Gates to testify on Monday, April 22nd. He will be the eighth Microsoft
witness and will take the stand in the sixth week of the trial.

Mr. Gates will testify on the evolution of the PC ecosystem and Microsoft s
role in fostering innovation in the PC industry. He will also testify on
how the remedies proposed by the non-settling states would imperil not only
Microsoft s business, but also cause harm to the PC industry and to
consumers. We will email you an embargoed copy of the Gates written direct
    testimony Sunday afternoon.
