Ridiculous Carl - The only Judge that would allow a court to equate Logging with Wiretapping is one that did not understand systems logging or timesharing. And then it was probably the opposing counsels fault for not understanding the material well enough to earn their fee.

I agree that people have proposed this but there is NO expectation of privacy in a TIME SHARING SYSTEM - if for no other reason that it is impossible for the OS's Scheduler to not know what you are doing, and to document itself, it uses the log Infrastructure.

But lets take it a step farther - what really needs to happen is that a regimen for initializing a logging session, adjusting the timebase at the start of a session and then tracking its divergence from UTC during the session. And this needs to codified as a small white paper that is a BCP for operating a logging system.

Additionally, as another factor to consider, even the act of recording the log in the first place is under scrutiny. It has been successfully argued that the logging of traffic on a computer network is a form of wiretapping, and therefore is covered by laws, both federal and state (which may be more restrictive than the federal). Banners which are carefully worded and legally meaningful, and consent recording ("By selecting the 'yes' button you agre to .....") are necessary.

Really need to check with lawyers knowledgeable about the subject (both federal and individual states) to ascertain the proper consent recording required.
