[Miller has been one of the most strident Microsoft foes; he applauded
Jackon's ruling in an almost unseemly manner. Now he's not quite as brash.

Judge Thomas Penfield Jackson last year found that Microsoft used its
monopoly power to crush its rivals, and ordered that the company be broken
up. But a federal Appeals Court now considering the case has harshly
criticized the ruling, as well as Jackson's comments to journalists
covering the case. Asked if there was any chance that the Appeals Court
would uphold the current judgment against Microsoft, Iowa Attorney General
Tom Miller replied, ''probably not in its entirety.'' Miller said it was
more likely that the Appeals Court would order the trial court to rethink
its original ruling, with a different judge appointed in Jackson's place.
